Most people know Randall Inniss through the tagline that has stuck to him over the years: Trooper2Lawyer. Between those roles, there was a remarkable chapter in professional sports.

Randall Inniss is a New York City native who currently resides in the Hudson Valley. He became a New York State Trooper at age 21 and, after rigorous State Police academy training, worked as a Trooper, Investigator, and Senior Investigator across many areas of the state — Binghamton, New York City, Buffalo, and surrounding regions.

He did not stop there. He completed his undergraduate studies at Binghamton University with honors, earning a B.S. in Social Science with a minor in Criminal Justice. With 11 years of state police service already under his belt, Randall attended the University at Buffalo School of Law while working full-time as a State Police Investigator, completing his Juris Doctorate in three years. Later, he earned an LL.M. in Criminal Law, also from Buffalo.

After his approximate 22-year State Police career, he was hired by the National Basketball Association — developing global security policy for 450 players, 30 teams, and the league's international markets, including work tied to the 2008 Beijing and 2012 London Olympics. After close to a decade at the NBA, he founded The Inniss Firm in 2015 to put that entire arc directly to work for people facing the New York criminal justice system.

Q 01Can a New York DWI lawyer help me keep my license?+
The short answer is yes. However, if a person refuses the chemical test at the station, their license is suspended at arraignment pending a DMV hearing. If the DMV administrative law judge determines you refused, your license is revoked for one year — regardless of whether you are convicted in criminal court. If it's your first DWI and you took the chemical test, you may be eligible for a conditional license during the period of revocation, which can allow you to drive to and from work and medical appointments.
Q 02Why do I need a defense lawyer for a DWI charge?+
A DWI charge not only invokes the state criminal justice system, but also the State Department of Motor Vehicles. Because there's a complicated relationship between two government agencies, New York courts will insist that you have an attorney.
Q 03What are my Constitutional rights at a New York traffic stop?+
You must turn over your driver's license, registration, and insurance card. That's about it. If an officer asks where you're coming from or whether you had anything to drink, you don't have to respond — you have a right to remain silent. However, if an officer asks you to step out of the vehicle, you must comply.
Q 04What is the difference between a misdemeanor and a felony?+
Both are criminal offenses. A misdemeanor carries up to one year in jail. A felony carries incarceration of more than one year in prison, along with potentially larger fines, probation terms, and other long-term penalties.
Q 05What is an aggravated DWI in New York?+
At the misdemeanor level, aggravated DWI is a BAC of 0.18% or more. At the felony level, it's being arrested for DWI with a child under age 16 in the vehicle.
Q 06What is a CDL DWI?+
A CDL is a Commercial Driver's License — the credential for driving a truck. A CDL DWI means a BAC of 0.04% or more (half the 0.08% regular-vehicle limit). That stricter standard applies whether you're driving a commercial or passenger vehicle at the time.
Q 07What is discovery, and when does it happen?+
After arraignment, discovery is the process where the district attorney's office turns over the police records of your arrest to the defense. Under New York law, the government has 35 days from arraignment (with some exceptions) to hand over everything in its possession, regardless of whether they intend to use it at trial.
Q 08Are most DWI cases resolved through a plea?+
Yes. Most DWI cases — and the vast majority of cases in the criminal justice system overall — are resolved through plea bargaining rather than trial. That said, many cases should go to trial: a CDL holder, nurse, physician, attorney, or chiropractor can lose their livelihood on a conviction, and trial may be the better call.
Q 09What should I look for in a DWI defense lawyer?+
Look for one who has handled numerous DWI cases and is not afraid to go to trial. Attorney Inniss is a former state trooper who made many arrests during his 20+ years on the job, is a member of DWI defense organizations, and is a qualified instructor in the Standardized Field Sobriety Tests that police use to develop probable cause.
